Mimi Terms of Service

Welcome to Mimi, a product of Moneytise (“Mimi”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of the Mimi mobile app and related services (the “Service”). By downloading, accessing, or using Mimi, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use Mimi

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Mimi. If you are under the age of majority where you live, you may use Mimi only with the involvement of a parent or guardian. By using the Service, you confirm that you meet these requirements.

2. What Mimi is

Mimi creates short, personalized audio — such as stories, affirmations, and sleep sessions — shaped around the words and intentions you provide, along with a gentle journaling and daily-thought practice. Content is generated using artificial intelligence and text-to-speech technology.

Mimi is a wellness and self-reflection tool for relaxation and personal use. It is not a medical device and does not provide medical, psychological, therapeutic, or professional advice. Mimi is not a substitute for professional care. If you are experiencing a medical or mental-health emergency, or thoughts of harming yourself, contact your local emergency services or a qualified professional immediately.

3. Your account

You can use parts of Mimi anonymously. To sync your content across devices, you may sign in with Apple. You are responsible for activity that occurs under your account and for keeping your device and sign-in method secure. Please tell us promptly if you believe your account has been accessed without authorization.

4. Subscriptions, free trial, and billing

Mimi offers optional auto-renewing subscriptions (“Mimi”) that unlock the creation of new personalized audio. Current plans include a Weekly plan and an Annual plan; the exact price and any free-trial length are shown in the app before you purchase and may vary by region.

• Free trial. If a free trial is offered, it begins when you start your subscription. If you do not cancel before the trial ends, it automatically converts to a paid subscription and your payment method is charged. Any unused portion of a free trial is forfeited when you purchase a subscription, where required by the applicable app store.
• Payment. Purchases are processed by the Apple App Store and charged to your Apple ID account at confirmation of purchase.
• Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Managing and canceling. You can manage or cancel your subscription anytime in your Apple ID Account Settings → Subscriptions. Deleting the app does not cancel your subscription.
• Refunds. Purchases are handled by Apple and are subject to Apple’s refund policies. We generally cannot issue refunds directly for App Store purchases.

We may change subscription prices or plan features going forward; any changes will apply to future billing periods and, where required, we will notify you in advance.

5. Your content

“Your Content” means the intentions, reflections, journal entries, and other text you provide to Mimi, together with the audio and scripts Mimi generates for you. As between you and us, you own Your Content.

You grant us a limited, worldwide, non-exclusive license to store, process, transmit, and display Your Content solely to operate and provide the Service to you — including sending the text you provide to our AI provider to generate your scripts and audio (see our Privacy Policy). We do not use Your Content to serve advertising, and we do not sell it.

You are responsible for Your Content and confirm you have the rights to provide it. Do not submit content that is unlawful, infringing, or that contains other people’s sensitive personal information without their consent.

6. AI-generated content

Mimi’s audio and scripts are produced by automated systems and may not always be accurate, appropriate, or exactly what you intended. Generated content is provided for relaxation and self-reflection only. You are responsible for how you use it, and you should not rely on it as professional advice of any kind. You may edit content before it is created, and we provide gentle safeguards, but we cannot guarantee that generated content will always meet your expectations.

7. Acceptable use

When using Mimi, you agree not to:

• Use the Service for anything unlawful, harmful, or abusive;
• Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service or its systems;
• Use the Service to generate content that is illegal, hateful, harassing, or that exploits or endangers others;
• Resell, redistribute, or commercially exploit the Service or generated content without our permission; or
• Circumvent usage limits, security, or subscription controls.

We may suspend or terminate access for violations of these Terms.

8. Intellectual property

The Service, including the Mimi and Moneytise names, the app, its design, software, and content we provide (excluding Your Content), is owned by Moneytise and its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the app for your own personal, non-commercial use, subject to these Terms.

9. App Store terms

You obtain Mimi through the Apple App Store, and your use is also subject to Apple’s applicable terms, including Apple’s Licensed Application End User License Agreement. You acknowledge that:

• These Terms are between you and Moneytise, not Apple, and Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the app.
• In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that generated content will be accurate or suitable for any purpose.

11. Limitation of liability

To the maximum extent permitted by law, Moneytise and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Moneytise and its affiliates from any claims, damages, or expenses arising from Your Content, your use of the Service, or your violation of these Terms, to the extent permitted by law.

13. Termination

You may stop using Mimi at any time and delete your data from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as content ownership, disclaimers, and limitation of liability) will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you in the app. Your continued use of Mimi after an update means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws applicable at Moneytise’s principal place of business, without regard to its conflict-of-laws rules. Nothing in these Terms limits any consumer-protection rights you may have under the mandatory laws of your country of residence.
